Fair Standard Act (FLSA) Lawsuit Update

If you have not heard by now, the local has retained Shane Youtz, Attorney at Law to represent the Union in its law suit against the City of Albuquerque for unfair practices regarding our compensation. We are still accepting consent-to-join the lawsuit and any information regarding improper pay. The union is encouraging any employees of the City of Albuquerque to join into the law suit this not just for union members or bargaining unit employees. All are encouraged to contact our office if you believe that you have an FLSA Violation.

Grievances/Arbitrations Update

The grievance committee chaired by Mr. Lee Whistle, Solid Waste Department is continuing to represent, settle and pursue through the arbitration process all complaints filed by our members. The work is difficult and if anyone would like to volunteer to assist the grievance committee, please contact Lee at 681-2766.

Important Arbitration Process
We cannot stress how important the arbitration process is. When we receive a favorable arbitration decision it becomes the basis for new language in the next contract negotiating cycle. Not only is winning the arbitration important to the grievant it is also important to the union membership for future contractual provisions. If you feel that the City has violated your rights, let us help you do something about it today. Start by filling out a grievance form.

Union Victories to Date
To date the Union has won 4 out 5 termination/demotion cases that the union chose to pursue with settlements of lost wages($$$$) and reinstatement in some cases. Your union is not just for when people get into trouble but about your rights, working conditions and wages. We will not strengthen any of these with out the membership getting involved.

Attend the union meetings, especially now that negotiations are coming up, as to what you want as far as Wages, Hours and Other conditions of employment.

Grievance Form

Guidelines for Writing a Grievance

  •  State the grievance in a concise description of the basic facts and information
  •  Don't include statements of personal opinion
  •  Don't include your evidence or arguments in the case - save those for when you meet with management
  •  List any and all management violations of the contract, work rules, etc., which apply; after you list specific contract articles, you may want to include a phrase such as "and all other applicable sections of the contract." This allows the chance to expand your arguments should additional details become known at a later time.
  •  Clearly state the desired remedy (that is, exactly what the grievance and/or the union want as a solution to the problem); make sure you ask the grievant what he/she wants before writing the remedy.

We Need Your Help

Organizing
We have been diligently compiling and updating our membership mailing list and formulating plans to increase membership, more commonly referred to as organizing. Our bargaining unit consists of over 1000 members and we would like to achieve 100% union brother and sisterhood.

If you are aware of any fellow management personnel that are not currently enrolled in dues deduction, help us help them. A simple notification to Maria or Molly Gallegos is all that is required, we will take it from there.

Often is the time, people are not union members simply because of a lack of information or too much incorrect information. We would like to reach out to these people and give them an opportunity to make our local the strongest in the City.
